Texas set to put to death man who received three stays of execution

(Reuters) - Texas is set to put to death Tuesday a man who has received three stays of execution and is requesting a fourth from the U.S. Supreme Court because of questions about the representation he received from defense lawyers.

Cleve Foster, 48, was convicted along with an accomplice of the 2002 murder and rape of Nyanuer "Mary" Pal, whose naked body was found in a ditch, according to a report by the Texas Attorney General's office.

The U.S. Supreme Court a year ago granted a temporary stay of execution just 2-1/2 hours before Foster was to be put to death by lethal injection. It was the third stay of execution from the high court for Foster, who also was granted a delays in January and April 2011.

Foster's lawyers have asked the U.S. Supreme Court for a fourth stay of execution, the high court said on Tuesday. The execution is scheduled for after 6 p.m. local time at the state penitentiary in Huntsville, Texas.

Foster's accomplice in the murder, Shelton Ward, died of brain cancer on death row in 2010. Foster maintained in his trial that Ward acted alone, and that contact between him and the victim was consensual.

The two men and Pal were regulars at Fat Albert's bar in Fort Worth when, the night before Valentine's Day in 2002, bartenders said Pal walked out with them, according to the report. Pal left in her car and the men followed closely behind in Foster's truck.

Eight hours later, Pal's body was found with a gunshot wound to the head and wadded-up duct tape nearby, according to the report.

Foster would be the 30th person executed in the United States this year and the ninth in Texas.

Texas has executed more than four times as many people as any other state since the death penalty was reinstated in the United States in 1976, according to the Death Penalty Information Center.

When you are a real estate professional, you, eat, sleep and breath real estate. It?s your life. It?s not like the corporate world where at 5pm, you turn out the lights, head out the door and don?t think about your job till tomorrow at 8:30 when you turn the lights back on. Real estate for me is 7 days a week. As part of that life, you are constantly monitoring news and events that can affect your business. A company announces new jobs, that could mean relocation employees.

So the article in The Atlanta Business Chronicle this past week about Atlanta?s condo inventory, was music to my ears! And it should be to yours too, if you are an Atlanta condominium owner. ?The 2012 Midyear Condominium Report from Haddow and Company shows new condo inventory at 1,520 units, DOWN from the 2011 Mid Year number of ?2,369 unsold units. Break out the champagne!

We are at inventory levels that have not been seen in 10 years! And with steady sales in 2012, the supply and demand is coming back in balance. If you want to purchase new construction condos in the Intown Atlanta Market, your options are becoming limited. Take that a step further to Midtown Atlanta, and your options are?.1010 Midtown and White Provision. Buildings like Luxe and Viewpoint Midtown have long Sold OUT! You can step over the Midtown line going North on Peachtree and you have The Brookwood and The Astoria. Downtown offers the W Residences and Twelve Centennial Park. (Castleberry Point in Castleberry Hill has live/work homes available but has sold all their remaining inventory!)

Our biggest challenge in the Atlanta condo market has been?price. During our condo boom, they buildings were popping up everywhere! Investors and owner alike were buying them up, but when the bubble burst, out poured short sales and foreclosures, drowning the prices.

The article states that in July, 2012, condo prices were up from $154,000 in July, 2011 to $189,000 in July, 2012?a healthy 23 percent increase! As I prepare my August, 2012 Midtown Atlanta Market reports, I?m seeing the same trend. Some buildings have seen as much as a $50,000 Average Sales Price increase from 2012!!

What does this mean for the Buyer? Well, $50,000 can make a big difference in what you may qualify for in a mortgage, and what you will be able to buy. The longer you sit on the fence, the shorter the grass (your buying opportunity) is going to be.

What does this mean for the Seller? If you are in a position (and desire) to sell your condo, with limited inventory, you very well may see that contract in a matter of days, not weeks. It may still be a challenge between what you get and what you paid, but with limited options for Buyers, we are starting to see multiple offers on properties!

I think we usually refer to a ?breath of fresh air? as relating to the Springtime, right? Well, Fall is in the air, the air is crisp, and the Buyers are looking!

It won't be long before $128 million doesn't buy the Lakers what it used to.

Like, by next season.

This season, that amount will cover the 2012-13 payroll and associated luxury taxes for a roster dripping with superstars Dwight Howard, Kobe Bryant, Steve Nash and Pau Gasol.

A year from now, it could pay for only a portion of that same roster and maybe a pair of Bryant's high-end sneakers. Keeping the core of the Lakers together could cost nearly $200 million.

NBA owners who like to pair eight-figure player salaries with their caviar are bracing for the party pooper known as more punitive luxury taxes, set to arrive in the 2013-14 season. Designed to expand the league's middle class and reduce the number of bloated contracts, the tax may force big spenders such as the Lakers to reconsider just how much they are willing to lavish on star players.

Then again, Jerry Buss has never been known to skimp on headliners, much less parade confetti, in his 33 years as Lakers owner.

"My feeling is that we'll continue to pursue the top players in the league," Lakers General Manager Mitch Kupchak said. "There will always be an emphasis on having the franchise be able to survive and prosper."

Even so, the cost of success is about to go up ? and up ? and up.

This is the last season the Lakers will pay a dollar-for-dollar penalty for exceeding the luxury-tax threshold, meaning that their league-high payroll of $99.2 million will cost them an additional $28.9 million in taxes, because that's how far they are above the $70.3-million tax level. The tax will raise the tab for their player costs to $128 million.

Starting next season, the tax burden gets significantly heavier. NBA teams must pay a $1.50-to-$1 ratio for the first $4.99 million they are over the luxury-tax threshold, a $1.75-to-$1 ratio for being $5 million to $9.99 million above the threshold, a $2.50 ratio for $10 million to $14.99 million over, and a $3.25 ratio for $15 million to $19.99 million beyond the threshold.

Teams that are $20 million or more over the tax level accrue additional penalties, increasing by 50 cents per dollar for every $5 million.

Those extra pennies can add up to millions, particularly for teams with multiple all-stars.

"All of these penalties are designed to try to change behavior and the thinking of the people that make the decisions and to try to make the cost of making the decisions outside the parameters more painful," said Peter Guber, co-owner of the Golden State Warriors. "How it will play out, you never know until you see it whether it changes the culture as well as the metrics."

The Lakers already have $79.6 million committed to eight players for the 2013-14 season. Assuming they re-sign Howard next summer to a maximum contract that calls for him to make $20.5 million in the first year, that bumps the Lakers payroll over $100 million.

If their final payroll was $105 million, that would put them $32 million over the league's projected tax threshold of $73 million, triggering a tax of $94.5 million and putting the team on the hook for a staggering total of $199.5 million ? a 55.9% increase over the total for this season with essentially the same group of core players.

Entries for the Mulvaney Bookmakers Open 525 Semi-Final are highlighted by those who have not raced at the open level before, and if any of the contenders did give it a try, the results were not heartwarming. The only note worthy entry for the 525 yards challenge is the three-year-old black dog, Lodgefield Start.

He could not win any of the two open races that he became a part of, but finished a respectable second at both the occasions. He has travelled well through the two seasons, racing the Grade T races and then coming up to the open level after competing in the Grade A1 to A2 level.

On 13th July, Hades Rocket?s son scored second in the Gain Greyhound 28 525 at Harold?s Cross over 525 yards. The collective favourite had drawn the fifth trap. He broke into an early pace, and steered through the traffic in a manner that he led near the line only, completing the trip in 28.74 seconds.

It was not by any highly significant margin that the three-year-old lost the race, he was kept adrift by the winner, Night Time Hawk, only by a short head?s difference.

Both the winner and the runner-up clocked the distance at the same time, but the Callery trained enjoyed just the slightest bit of advantage when it came to the margin.

The black dog out of, Lodgefield Dawn, then monopolised the second spot in the Greyhound Sales @ The Cross 550 on 20th July, 2012 at Harold?s Cross. Breaking out of the second trap, the Traynor trained led the track from the third position, and ran to the wire in 30.37 seconds.

The evening?s favourite missed the winning spot by the margin of 1 ? lengths as the winner, Roll On Rover, claimed the ?400 prize money in 30.25 seconds.

The three-year-old has prepared for the race by concluding a Grade T1 over 525 yards in 28.83 seconds on 15th September, 2012.

The 3 to 1 entry shares the odds with Rathbawn Tommy and Pucker Up. The rest contesting in the race tonight include The Other Walker, Lady Blackpool and Lanesdown Pen.

    Tulsa, OK Real Estate Market Update | Tom and Bev

    Tulsa area foreclosures continue to decline month after month. Since July, repossessions in the Tulsa area are becoming less common, continuing a general downward trend. According to RealtyTrac, there were 572 foreclosures recorded in the Tula metro area last month.Tulsa OK Real Estate Update

    The foreclosure rate now results in one for every 716 homes, which is 3.5% below June and 28.8% below July 2011. When compared to the state of Oklahoma?s foreclosure rate, Tulsa is still much lower. There were 1,369 foreclosures throughout the state of Oklahoma, which is an increase of 5.8% for the month; however, that is down 32% for the year compare to one year ago.

    The nation?s foreclosure rate is also down 3% for the month and 9.8% for the year. That?s an average of one in every 686 homes facing foreclosure. RealtyTrac also reported the decline represents a 22 start year-over-year drop since recording started.

    Foreclosure patterns vary significantly from state to state, mostly depending on how dysfunctional the state?s foreclosure process is. California currently has the highest foreclosure rate in the nation with one in every 325 homes going to foreclosure.

    St. Hildegard of Bingen (1098-1179) is a wonder of the past, a historical phenomenon in her own right, and a direct challenge to all who bother to learn about her and from her now in the twenty-first century.? In short, Hildegard?s life and writings pose a stark question: did God speak through this woman, not only to people of her day but to all mankind for all time, or was she one very sick woman?

    Hildegard spent almost the whole of her long life in the valley of the Rhine, near where the River Main flows into it. The middle Rhineland valley is one of the most fertile parts of Germany, with a mild, temperate climate, where people have lived in communities for millennia. The Rhine forms a natural highway from its origins in the Alpen lands to its mouth in the English Channel and North Sea. The paradox of Hildegard?s life is that she was a solitary, contemplative soul, living on a major highway, so to speak, where she became the center of attention.

    Born one of perhaps ten children to a local, noble couple, Hildegard probably had a fairly privileged and normal early childhood, except that she suffered from an illness that confined her to her bed. During these bouts of weakness and pain, she began to see unusual images, perhaps from as early as her fifth year. When she told people about her visions, they told her to be quiet. When she was seven, her parents resolved that she should become a religious, and so turned her over to Jutta, an anchoress, enclosed in a stone cell that was adjacent to a Benedictine monastery. There Hildegard lived, studied, worked, and prayed for thirty years. More and more girls came to live with them, until Jutta became the head of a small Benedictine convent. When Jutta died in 1136, when Hildegard was thirty-eight years old, the community of religious women unanimously chose her to lead them. Little is known about these three decades of Hildegard?s life, except that her bouts of illness and the visions continued. She told only Jutta about them, but Jutta informed a monk, Volmar, whose position was to supervise the nuns and administer the sacraments for them.

    Hildegard?s life changed radically when she was forty-two. She had the most powerful vision yet, one not just of lights and images, but of inspiration, of understanding, an infusion of knowledge about the meaning of Scripture and the whole content of the faith. She also received the command to write down what she learned. Feeling unequal to the task, Hildegard fell gravely ill. Volmar told her to write, and the abbot of the adjacent monastery concurred. Her illness lifted, and she began to write of what she had seen, in Latin, which she had not learned very well, working with Volmar, who assisted her for the next thirty years. Her first and greatest work, Scivias, tells in three books of God and all of his creation, of redemption, the Church, and the devil, and finally about the whole history of salvation. First the abbot read portions of it, then the archbishop of Mainz, then St. Bernard of Clairvaux and the Pope himself, Eugenius (1145-1153), who read her writings himself out loud to a synod held in the German city of Trier. The word was out. A true prophetess lived on the Rhine. Hildegard?s solitude, as limited as it had been, was over.

    New vocations flocked to her convent. Perhaps in part to separate the sheep from the goats, she moved her community to an unsettled, forested hill on the bank of the Rhine and started building the new convent from the ground up. But the flow did not stop. Within a few years she had to found another convent, this time on the opposite bank of the river. As abbess, she visited that monastery once or twice per week. People flocked to hear her speak, to receive her blessing, and to obtain treatments for their ailments. She later published a large treatise about many sicknesses and the way to cure them using plants, herbs, animal parts, and precious stones. She corresponded widely with the highest echelons of medieval society: Holy Roman Emperors, popes, kings, bishops and archbishops, princes, abbots and abbesses, and many priests, nuns, and noblemen. Well over 300 of her letters survive today, and certainly many, many more were written during her long life.

    She was asked for advice, for knowledge of the state of people?s souls, for explanations of Scripture, for theological explanations of divine mysteries, for knowledge of the future. She was called to meet the Holy Roman Emperor and made predictions for him that he said later came true. She spoke and wrote what came to her, whether of good or ill tidings. Her inner voice told her many things to complain about. She held nothing back when lacerating corrupt clergymen and prelates for their abuses of the Church, of selling offices and allowing themselves lives of pomp, luxury, and plentiful sexual pleasures. When a prior wrote to her to ask her to pray for him because he was doing so for her and wanted a good outcome for his affairs, she scolded him roundly for his selfishness and pagan understanding of prayer. We have no way of knowing how many people held her in awe.

    In addition to hundreds of letters, she wrote another book about the moral life and its merits, a visionary work like Scivias, about how we are to live in order to partake in Heaven?s peace and glory. Another book is devoted to describing the works of divinity. In addition to the medical treatise, she wrote books explaining how nature works according to God?s mysterious precepts. She was shown divine order in all things and endeavored to convey that order to others. ?She also composed seventy songs and a musical morality play about the virtues. Her style, in prose and in verse, is always vivid, compelling, and loaded with prophetic imagery; it is the opposite of dry academic, technical writing. Nonetheless, it is not easy to differentiate precisely among what she received in a vision, what she learned from other books and local, oral tradition, and what she observed and thought up herself.

    Obviously such prominence without any formal credentials or raw power to back it up led her into some troubles. It took much effort to persuade the abbot under whom she had lived with Jutta to allow her to move her nuns, and their dowries, to the new location on the Rhine. Her admonitions to powerful, sinful clergymen and laymen added to her list of potential detractors and enemies. Some people said she was a self-serving fraud, or just crazy. Her battle with her bishop to keep her prot?g?, the nun Richardis, from going to lead another convent was a lost cause, the pope eventually intervening to back up the bishop. The affair did not bring out the best in anyone. Toward the end of Hildegard?s life, she allowed an excommunicated man to be buried on her convent?s holy grounds; she said he had been properly reconciled with God just before his death. The bishop disagreed and put her convent under interdict, denying Hildegard and her nuns access to the sacraments, but Hildegard wore him down with prayers and supplications. Within a few months, the interdict was lifted, and the grave remained undisturbed. These conflicts, however, were exceptional rather than normal.

    The fact that she was a woman living in the twelfth century was no serious hindrance to her mission to spread the word of God?s revelation till the end of her days. Beginning in her sixties, she went on four lengthy tours through the local countryside, preaching, with papal approval, no less, to the Church, clergy and laity alike. Her songs were sung as far away as Paris, and word of her wisdom spread across the face of Christendom. After her death at the venerable age of eighty-one, a cult devoted to her sprung up immediately. While there is no record of her official canonization in the twelfth or thirteen centuries, she was listed among the saints in the sixteenth-century Roman Martyrology. Just recently, Pope Benedict XVI inscribed her in the catalogue of saints (an action called ?equivalent canonization?) on May 10, 2012, and on October 7, 2012, will declare her a doctor of the Church, a recognition granted to only thirty-three people thus far, three of them women.

    But, this being the twenty-first century, many people just will not accept that God had communicated anything, let alone truth, through Hildegard. Some historians have diagnosed her life-long sufferings as migraines, but to explain the derivation of her visions in medical terms have all failed grandly. There is no denying that some of her symptoms resemble migraines, but the power and richness of her visions, and the depth of her understanding of them, have another, very different source.

    She is not an unknown quantity in Germany today, but most people know her name for the wrong reason. There is a product line and a .com named after her that hawk herbal elixirs, potions, creams, powders, rocks, and ointments, all marketed to improve one?s general happiness and feeling of freedom and independence. Hildegard?s priority for others, however, was sanctification and salvation. The products claim to be based on her writings, but they are more in line with new-age commercialism. More serious and more worthy is the association (Bund der Freunde Hildegards) that publishes a quarterly journal and includes a network of doctors, chiropractors, and medical researchers who make a real effort to apply her remedies and methodologies to problems people face today. But this group has missed Hildegard?s religious message almost entirely. On a more popular level, German film-makers released a feature about her in 2009, ?Vision: From the Life of Hildegard von Bingen.? The movie shows her as nun, abbess, writer, composer, and medical practitioner, finally ending with her riding off for a preaching tour. Unfortunately, however, the film fixates on her struggles for recognition from men of the Church as well as independence from their control. The screenplay is about a poor, oppressed twelfth-century woman?s fight to become fully herself in the face of a mediocre, jealous, sexist, male ecclesiastical hierarchy.

    Hildegard was and is so much more. Quite simply, she was a great saint. She suffered and struggled terribly. She loved God above all and sacrificed all to please him. She persevered to the end. She inspired people in uncountable numbers. She told them to stop sinning and embrace holiness. To get to know her, read her writings. Some images will strike you as exotic or bizarre, but the wisdom of her moral injunctions and religious insights deserves serious consideration and great respect.

    When a huge meteor collided with Earth about 2.5 million years ago and fell into the southern Pacific Ocean it not only could have generated a massive tsunami but also may have plunged the world into the Ice Ages, a new study suggests.

    A team of Australian researchers says that because the Eltanin meteor ? which was up to two kilometres across - crashed into deep water, most scientists have not adequately considered either its potential for immediate catastrophic impacts on coastlines around the Pacific rim or its capacity to destabilise the entire planet's climate system.

    "This is the only known deep-ocean impact event on the planet and it's largely been forgotten because there's no obvious giant crater to investigate, as there would have been if it had hit a landmass," says Professor James Goff, lead author of a forthcoming paper in the Journal of Quaternary Science. Goff is co-director of UNSW's Australia-Pacific Tsunami Research Centre and Natural Hazards Research Laboratory.

    "But consider that we're talking about something the size of a small mountain crashing at very high speed into very deep ocean, between Chile and Antarctica. Unlike a land impact, where the energy of the collision is largely absorbed locally, this would have generated an incredible splash with waves literally hundreds of metres high near the impact site.

    "Some modelling suggests that the ensuing mega-tsunami could have been unimaginably large ? sweeping across vast areas of the Pacific and engulfing coastlines far inland. But it also would have ejected massive amounts of water vapour, sulphur and dust up into the stratosphere. "The tsunami alone would have been devastating enough in the short term, but all that material shot so high into the atmosphere could have been enough to dim the sun and dramatically reduce surface temperatures.     In the paper, Goff and colleagues from UNSW and the Australian Nuclear Science and Technology Organisation, note that geologists and climatologists have interpreted geological deposits in Chile, Antarctica, Australia, and elsewhere as evidence of climatic change, marking the start of the Quaternary period. An alternative interpretation is that some or all of these deposits may be the result of mega-tsunami inundation, the study suggests.

    "There's no doubt the world was already cooling through the mid and late Pliocene," says co-author Professor Mike Archer. "What we're suggesting is that the Eltanin impact may have rammed this slow-moving change forward in an instant - hurtling the world into the cycle of glaciations that characterized the next 2.5 million years and triggered our own evolution as a species.

    "As a 'cene' changer - that is, from the Pliocene to Pleistocene - Eltanin may have been overall as significant as the meteor that took out the non-flying dinosaurs 65 million years ago. We're urging our colleagues to carefully reconsider conventional interpretations of the sediments we're flagging and consider whether these could be instead the result of a mega-tsunami triggered by a meteor."

    iOS 6 now available, here's what you need to know

    As Apple promised it would be, iOS 6 is here.? We gave it ? and the 200 or so new features it brings ? a close look. Here's are the key things you need to know about the latest version of Apple's mobile operating system.

    Can?your device handle iOS 6?

    According to Apple, you should be able to run iOS 6 on an Phone 3GS, an?iPhone 4, an iPhone 4S, a?fourth-generation iPod Touch, an?iPad 2 or a?third-generation iPad.?Yes, this means that folks with older iPod Touch devices, the original iPhone, or the iPhone 3G are officially out of luck.

    Now, that's the official word. But?it's worth noting that?? like some other updates?? this particular iOS version might leave some of the older supported device feeling a bit sluggish. Keep that in mind, especially if you're using an iPhone 3GS, which was already left feeling a bit slow after the jump to iOS 5.

    What makes iOS 6 so much better than older versions of iOS?
    There?are over 200 new features to be found in iOS 6, but?? as always?? some stand out. Here are the key changes to know.

    Siri
    Siri has gotten some significant improvements in iOS 6. She's learned a lot of new languages (Italian, Mandarin, Cantonese, and more) and become friends with a lot of new services (such as OpenTable, Yelp, Rotten Tomatoes, and others).

    This means that you can now get way more information directly from the personal assistant instead of being told that she'll search the Web for you. Now Siri will provide you with sports scores, movie times, and detailed restaurant information. On top of that, she can even help you make restaurant reservations, tweet for you, and even launch apps.

    While Siri still isn't perfect, these changes are rather great and make it more likely that you'll actually use Siri for certain task instead of just treating her as a joke generator.?

    Although ... if you do use Siri to amuse yourself, you may be happy to know that she's picked up some more jokes since the last time we explored how she says the darndest things.

    Passbook
    A new app called Passbook can store many of the things which normally clutter up your pockets. Boarding passes, discount cards, movie tickets, gift certificates, and so on can be contained securely within Passbook.?

    Since the app has location support, it will also pull up the relevant item when you are near the place in which you'd use it. This means that your Sephora loyalty card will be right on your screen as you reach for a new lipstick, your boarding pass will appear as you arrive at the airport, and your Starbucks card will pop up as soon as you smell the coffee beans.

    Facebook
    Like Twitter, Facebook is now deeply integrated into iOS. You can post directly to the social network using a "tap to post" button in the Notification Center, from the Photo Roll, and more. And to make your life easier ??in theory, anyway ??you can allow events and birthdays which are listed on Facebook to populate in the Calendar app.

    Do Not Disturb
    Words can barely convey how incredibly useful the "Do Not Disturb" mode found in iOS 6 is.?This little feature allows you to silence alerts and calls for a while in way?significantly?more clever than what's offered by the regular volume toggle.?

    You can designate regular "quiet hours" during which Do Not Disturb mode will automatically kick in, you can choose to allow calls from people who are listed in your favorites or contacts to ring through, or you can tell your iPhone to ring if someone calls twice within three minutes.

    Maps
    Not everyone will like how the Maps app has changed in iOS 6.?Apple has ditched Google Maps and now uses its own mapping solution (which is powered by TomTom).?This means that the Maps app is a wee bit different. There's Yelp integration, traffic information based on crowd-sourced data, automatically re-adjusting routes, and turn-by-turn directions.?

    Yes, you read that right. There are finally turn-by-turn directions directly in the Maps app. And they're rather solid. (If they manage to get someone as?? ahem?? lacking in navigational skills as yours truly somewhere, they'll get anyone where he or she needs to go.)

    Oh! And?Apple also added something called "Flyover" to Maps. This feature makes the whole world look a bit like a Sim City game by showing 3-D models of geographical features and buildings.

    There are naturally some downsides to the revamped Maps app, of course. Without Google's gigantic and well-established pile of data, the Maps app can occasionally fail to find certain points of interest, lacks detail at certain zoom levels, and lacks public transportation information. They're tolerable shortcomings, but the Wall Street Journal's Walt Mossberg went as far as calling them the?"biggest drawback" of the iPhone 5 (which ships with iOS 6) when he reviewed the device.

    Privacy
    The new "Privacy" menu in the iOS 6 settings will help you sleep far more soundly at night. It breaks down the various items to which an app might request access (Contacts, Photos, Location Services, etc) and allows you to toggle each app's access to the item on and off.

    This is a great way to check whether you accidentally gave an app more information than you intended?? and to simply take back some control later down the line.

    Reply With Message and Remind Me Later
    Odds are that you'll occasionally find yourself in a situation which prevents you from answering a call which matters. It's inevitable. But with iOS 6 you at least have the option of quickly replying with a preset text message or setting a reminder to return the call at a later time.

    You can do either of those things in about the same amount of time it would take you to swipe your finger across your iPhone's screen.

    What do you need to do before upgrading your?device?to?iOS 6?
    Before you try upgrading your device to iOS 6, you need to make sure you have the latest version of iTunes. After you've taken care of that, you should really consider backing up your device?? just in case something goes wrong.

    All you need to do in order to back up an iPhone, iPad, or iPod Touch is connect it to your computer, open up iTunes, right-click the gadget in the "Devices" menu, and select the "Backup" option. The software will take care of the rest. Once the backup process is complete, feel free to tap the "Check for Updates" button to get the iOS 6 download started. iTunes will walk you through the rest of the upgrade process. (Alternatively, you can also just update your device "over the air" by opening up the Settings app, tapping on "General," and selecting "Software Update.")

    German faith in euro and EU lags behind French: poll

    BERLIN (Reuters) - Almost two thirds of Germans think their country would be better off without the euro, according to a poll published on Monday which highlighted growing unease in Europe's largest economy about the costs of the euro crisis.

    The survey for conservative daily Die Welt was carried out in July by TNS Emnid on just over 1,000 people each in the euro zone's top two economies, Germany and France, and in Poland, which is a member of the European Union but outside the euro.

    Despite the continued resilience of their economy during the euro debt crisis, Germans are increasingly upset about having to bail out weaker euro zone member states such as Greece and fear that the crisis may erode their savings.

    In contrast to Germany, only 36 percent of French people polled thought France would fare better outside the common currency, the survey showed. The French were also more positive about the general benefits of EU membership than the Germans.

    Just over one third of the French respondents believed they would be better off without the EU compared to 49 percent of Germans polled.

    Poles have little enthusiasm for joining the single currency despite strong support for EU membership, the survey showed. Only 18 percent of Poles surveyed believed they would be better off swapping their zlotys for euros while 76 percent thought they would be in a somewhat worse or much worse situation.

    But Poles are more optimistic about the job prospects offered by the EU than the French or Germans. Many Poles have moved west in search of better-paid jobs since their country joined the EU in 2004.

    Only 24 percent of Poles thought their employment prospects would be easier without the EU, against 37 percent of Germans and 34 percent of French people surveyed.
